It's up to the D.A.'s office which charges are filed. An officer can arrest him based on probable cause, but it is up to the D.A. to actually file the charges. If this guy is on Probation in Sacramento County and continues to engage in behavior consistent with narcotic sales and use, you might want to consider notifying his probation officer. They are normally eager to help, and part of their job is to supervise and keep tabs on convicted felons in lieu of being sent to jail or prison.
I completly understand your frustrations. The sign of the times is the decriminalization of repeat drug offenders. Instead of lengthy jail sentences, offenders are released and asked to participate in a rehab program. For most, this is a difficult task with a very low success rate.
My hats off to the people who have managed to stay clean. You should be extremely proud of your achievement.

Well it says that he is still in custody, and it used to say projected release date 3/11 and now it says none..he was on probation according to the Sacramento court page. Maybe they are going to keep him? I wonder what that does to his property? Does anyone know?

If he foreits his bail bond then the house could get a lien put on it. Which means it could be auctioned off.

It says released 3/11/07.
"Sometimes on purpose and sometimes by accident, teachers' unions have a long history of working against the interests of children in the name of job security for adults. And Democrats in particular have a history of facilitating this obstructionism in exchange for campaign donations and votes." . . .Amanda Ripley re "Waiting for Superman" movie.

He's a very long way from having the "3 strikes" law imposed. Their are several loop holes that come along with that law. Unless he has at least 2 violent felony convictions on his record, a simple possession of methamphetamine charge is not going to put him away for 25 years. Upon arrest his probation is revoked so that he does not get credit for being on probatin while in custody. He will get a new termination date for probation (if it is granted) after this case goes through the judicial process. At his point, I would suggest that his neighbors continue to report any suspicious activities or problems you are having with the residence to the Folsom PD. Eventually this guy will get tired of dealing with us and hopefully clean up or move away.

It's obvious he back. it was quite loud again there. How can someone afford to continue that lifestyle without working?

Did you know they were locking that poor little girl in the theatre? I can't see you letting that happen.

Sactoman, I don't want to tell you how to be a dad or anything but you might want to consider getting your little girl tested for HIV. God I hope she was never around any of those needles but this sounds so sad.

she has been tested and checked out by doctors, my worry is the mental issues as she gets older and can hear what her mom is doing and has done. As of now she just knows mommy is around bad people and got in some trouble.

She sounds like a tough cookie...I think everything is looking up from here. Once her mom gets caught and get help, even if it's forced on her, things should get better.
