If you read the details, it allows the PeeResident to proceed until the actual legitimacy of the use of funds is decided, probably by the entire Supreme Court.

Ya don't wanna count your chickens before they hatch.

 

The Constitution gives the power to allocate funds to the legislature, not the executive branch,

so this is an important distinction.
