I just reviewed the CC&R's for another reason.... and stumbled upon Article IV within the CC&R's packet. Article IV is entitled Disclosures....

Item 4.01 reads:

4.01 Sport Facility Disclosure The City intends to place an active Park and Recreational Facilities with active sports facilities lighting in and adjacent to this Development. The light and noise associated with the sporting events and other use of the Parks and Recreation Facilities will be present during various times including but not limited to evening hours.

(now here is where I become really unpopular) This was disclosed to us (Willow Springs residents) as we were signing a pile of papers..... at the title company. We signed something indicating that we have read these items and agree to abide and understand. Renters dont get off the hook either... as renters (per CC&R's) have to abide by the same as well as be disclosed the same information.

So where does this put us.... Well.... they told us what they were going to do... and we signed something indicating that we understood this..... but we now choose to complain about the light and noise (parking is a different issue to be discussed later). While I do not understand complaining about something you were told of..... heck this is America and it is your right..do what you feel is necessary.... just thought I would point out the fact that they told us..... and we knew before we finished our home paperwork. Can we work with the city and Parks and Rec to mitigate the noise and lights.... surely.... and I would encourage all to do so....

Now onto parking.... what the disclosure failed to mention is that the entire neighborhood would be stock full of cars.... in my opinion.... there is a reasonable expectation that the "active sports facility" be able to handle parking for the associated events..... in this regard I agree completely with parklady in that there was some very poor planning surrounding parking facilities... this portion of the topic needs to be addressed with the city and Park and Rec and parking is horrible and will not scale into the future.

I couldn't agree more. Thanks for your interesting post. While the facility was a known and apparent fact which grew well beyond the develper's descriptions, this does not relieve the obligation of the city and the league to mitigate its negative impacts. My concerns are and have always been focused primarily on the traffic and parking as the most negative and dangerous impact of this facility. Minimal solutions such as the dirt lot (where relatively few park) have not made enough of a difference, especially as the league grows. However, I appreciate the effort the city has made. I believe that perhaps they are attempting the conservative approaches first. Eventually, without parking signs or dedicated parking facilities at the park site, which will alter plans to develop other facilities/fields on this site, there is no real solution for this neighborhood. Of course, the ultimate solution is to give these kids a real stadium in more appropriate and safer surroundings. I cringe as do my neighbors everytime I drive down the street in the midst of one of these events, with all the kids and people darting across the street to the field. A fatality waiting to happen....
