I have a coworker who didnt work w/the builder for repairs. Did the lawsuit, took over 5 years to settle, put more $ into the suit than he received in the settlement, said it was not worth the emotional stress and if hindsight was 20 /20. . . .

These class action lawsuit letters crack me up. Classic definition of ambulance chasers. They mail these letters to everyone with a home under 10 years old asking if you want to sue for anything. Just like sitting in the emergency ward and asking everybody that walks in if they would like to sue someone for there injuries. And who pays for all of the extra lawsuits? Us Californians through higher prices and higher insurance rates due to the increase in lawsuits here.

Sign up for the class action suit. They did that here a few years ago in Briggs Ranch against Wincrest homes. We got the letters in the mail and just threw them away thinking it was a waste of time. I just found out last year that one of my neighbors got 12K just for signing up. Sounds like a pretty good deal to me as these houses are half crap and we could have used the money for new windows right now.

Everyone thank you for the feedback. MAK said the same thing it wouldn't matter the actual damage to the home I could probably get about 10K after their legal fee just for being in the lawsuit. If anyone knows how to contact the builder of Award Homes that built homes in Tracy, CA I would appreciate it. I would rather contact them and mention the class action and even come to an agreement to have it fixed even on my dime. I don't like the idea of having the legal disclosure on my home.

All-

This is a follow-up. I have been given a tentative settlement by MAK that is ok. The amount would allow me to fix an incorrectly installed patio. The home was inspected by the homebuilder’s inspectors. The attorney mentions that if I do not request a copy of the detail home inspection I do not have to disclose to a potential buyer in the future. I do not believe I have the ability to get more money from the homebuilder since most of the subcontractors no longer exist. I am also not the first homeowner. The homebuilder has refused to do any repairs.

This is a subjective opinion. Would you get the home inspection report understanding knowing could cost you a large amount of money when it comes time to sell due to disclosure?
