The YES votes came as expected from Steve Miklos, Jeff Stasky and a little bit surprisingly from Andy Morin.

Thanks to Kerry Howell and Ernie who strongly supported the appellants and the public and voted a big NO.

Jeff Starsky took the new tactic of using a very loud buzzer to interrupt anyone speaking at the time limit, and set the time limit for the public to 2 minutes instead of 3 minutes as was noticed would be allowed.

Does anyone know if this vote can be overturned by a referendum by the people?

Transcript of the debate, to save you watching through 8 hours of budget meetings:

City council: Open for discussion
Public: No, No, No, No, No, No, No, No, No, No, No, No, No, No, No, No, No, No
Developers rep (aka ex-Mayor Bob Holderness): But we want to anyway
City council: Pass

Did Holderness satiate his phallic obsession by fondling the microphone while he spoke?

Robert, I thought if anyone could answer this question, it would be you. haha

I don't know if the people can overturn it or not. Anyone else...

Is it considered an ordinance? Here is the section of the State elections code for creating local referenudms on overturning ordinances:

http://www.leginfo.c...;file=9235-9247

The first step is getting signatures equal to 10% who voted in the city in the last Presidential election to overturn the ordinance.

I don't think it is an ordinance. It's described as a resolution in the notice camay posted. I'm no expert, though.

It's so disappointing this is going to be built.

There are only so many hours in the day for getting up to speed on Recalls, I don't have time to look at referendums.

There should be some mechanism to overturn a vote of the council. Ultimately, its the will of the people that should prevail.

I sent an email to our council members this morning expressing my disappointment and asking those who voted "yes" to explain to me why they did, asking them to sell me on why it was a good decision. I just received a response from Kerri Howell, which I'll share here:

"Thanks for sharing your thoughts. The only bright spot I can see in this whole thing is that they are not likely to get permission to put the landscape easement on the Rail JPA property - so, I am hoping that at some point in time, if someone comes forward to actually build something there, there will be another shot at getting this approval overturned - hope springs eternal - I agree that this is now and always has been a really bad idea - I don't ever want to see anything at this location!

Kerri Howell"

I'm not crossing my fingers for a response from everyone. Kerri is the only one who has consistently responded to the few missives I've sent to the Council.

Kerri's the best, I'm really glad she's on the council to try and keep things focused on the city's best interest.

What gets me is that the attorney for the group that wants to build there is an ex Mayor of Folsom. What is he doing, filling his pockets with money. I think he gave up thinking about the good of Folsom.

Back when Holderness was on the council someone was proposing a nine hole golf course off White Rock. Holderness was against it saying it would create too much traffic. How ironic.

I hate to get on my Soap Box.

So I won't, I'll keep it short and sweet.

1) Have never had a good dealing with Miklos. He has out and out lied to me and other people on issues and I hope someday soon that he is out of office. Frankly, in my humble opinion, he would vote yes on anything that would benefit his pocket book or allow him to keep up with the jonses. (not what is good for Folsom)

2) Thank goodness at least some people in the city still have some sanity left. (Kerri) As for the those that voted yes, I really need to move across the street from my Orangevale Address to Folsom and run next election time frame. A trained monkey could do a better job than people like Miklos and you can quote AND print that.
