I'm confused. I said it's not illegal to possess standard capacity magazines. You said it's not true but then point out references to suggest that it is, in fact, legal to possess but would add enhancements in the commission of a felony (for which I don't disagree but that wasn't in context).

I think one of us is not understanding the other. This isn't a matter of interpretation, is it?


yes, it is actually not you or me; but a point in difference in the california judicial system. Several years ago, someone came up with a brilliant idea to enhance punishments of semi automatic or automatic weapons involved crimes. I think this happened after a failed attempt to outlaw the AR 15.

So there is a pc on certain types of large capacity magazines being used during a felony, I just can't find it. They aren't saying it is illegal to own, but you can't buy, sell, trade. And you can't use it to commit a felony.

Don't ask me how you can posess without buy, sell, or trade.. Unless you owned prior to the law?

Disclaimer: I'm not a lawyer, on TV or otherwise.

Buying or receiving is not illegal. Selling, giving, importing, manufacturing is. You can buy. You can also possess grandfathered mags. You can also find (in state). You can come into possession a number of different ways. There are specific ways that regulates transfers though.

With these rules that were passed on these types of magazines- you may as well call it a ban. Just a little less face loss for the people who argued against it.

I knw when I first came back to CA after a long stay away, I was considerng buying or building an AR 15, custom specs. I abandoned the idea after reading some confusing stuff on what is legal or not when modifying a build.

I wonder how true that is, anymore? I mean, when is the last time statistics have been done on armed homeowners shooting at suspects and actually shooting a relative?

I just wonder because we have all heard someone say that in gun safety classes, but in reality I don't hear oo many times on the news that someone accidentally shot a relative while trying to repel a home intruder.

I would say that's a fallacy. One can be proficient in the use of cover and in reloading such that this would not be an issue.

The 10 round mag cap (BTW, only 6 states apply a magazine capacity limit) may have originally been driven by business interests, not really as a matter of efficacy.

You're thinking like someone who doesn't own a gun, not someone who has one and might face a someone who doesn't care about magazine capacity laws. Banning them doesn't mean that they cease to exist. In fact, it's not illegal to have them.

Ok, I'm wrong. Whatever. However comfortable you may feel with a six shot revolver doesn't give you the right to limit how many rounds I can carry in my magazine. I don't want to debate revolver vs semi-auto, calibers, the myth of a one-shot stop, engagement of multiple moving targets or anything else. You prepare as you see fit, I'll do the same.
