Not unless your breaking into encrypted networks and doing damage. Is it a crime to drive around my neighborhood with my laptop? It's not my fault certain networks creep into the streets.

When did I say I "go around" and hack people's WEP keys? If you're referring to this:

QUOTE(uberman)
I "discovered" (aka hacked,) four of my neighbors WEP enabled wireless networks in less than 10 minutes. I could have very easily bridged their networks into mine and used their bandwidth, but chose to of course, let them know how sh1tty wep is.

Then you have mistaken the intent, I hacked these four networks with my neighbor's permission, hence the "let them know how sh1tty WEP is." I had just gotten my laptop and wanted some wireless access, so i asked my nearest neighbor and she let me in, in return I secured her network more thoroughly.

Don't jump to conclusions, before you do so, make sure you thorougly read what i write.

Zach5: why aren't you answering my d@mn calls in GoogleTalk!?

Actually, it is a federal crime to access a network without permission. And accessing a private party's or a company's wireless network without permission is punishable.

The very first known conviction for accessing a private wireless network was handed down in 2003. More popular was the conviction a couple of months ago of a guy was caught in his SUV infront of a private residence. Monitoring of the wireless network plus auditing of the laptop being used in the SUV showed the guy was infact accessing the internet via the wireless router in the residence that he didn't have permission to access.

And he was convicted! One guy got 18 months probation and an $18,000 fine for doing exactly what you are describing.

Wardriving is legel, taking it one step further is a crime...

This isn't news... we all knew this already.
