Yes, I used Jim Schmidt, since he is listed as agent for service of process on the Secretary of State website. According to the small claims website info, other corporate officers can also be served. I paid the $10 for the court to attempt certified mail service (only the court can do this, not the plaintiff, according to the instructions on the website.) If this method of service fails, I will have to hire a process server, as I cannot serve the defendant myself, and I don't think my friends and family really want to do it!

Looks as if SacDJ is still trying to prove his point on how "solid" My Free Travel was. I just filed into a class action lawsuit with Grant's Appliances. I'm not sure how Beck's advertised this promotion but there was no 2nd party listed on the contract I signed, just a promise for $500 cash back by sending in receipts. Yes, I might only get 2/3 of what they promised but I would be a lot happier to see Beck's and Grant's both go out of business and the operators of MFT go to prison.

Got today a phone from California Department of Consumer Affairs, they asked me whether I accept Beck's offer...I said- NO.
I was told that they are going to communicate it to Beck's and will be the last attempt for them to mediate.
After that I was recommended to file a small court claims.
I guess soon we will see Lara in formal dress lmaosmiley.gif

I got the same call from Dept. Consumer Affairs as Folsom 2008.

I declined the opportunity to have my rejection of Beck's offer communicated to Beck's.
Thus, the Dept. closed my complaint as being referred to small claims court.

I have already filed in small claims court and believe I have a good case.

I encouraged the Dept. of Consumer Affairs to look into a case against Beck's on the basis of unfair competition under Business and Professions Code section 17200. I'm not sure if their actions would be considered false advertising under section 17500, because there may be lack of intent. However, Beck's actions now, breaching thousands of contracts I believe could be the basis for a complaint by an entity like Dept. Consumer Affairs. Each act of unfair business practice is a penalty of $2500. Take that times thousands of Beck's customers, and Beck's gets a pretty big slap on its hand.

For me, I just want my money Beck's is contractually obligated to pay, and hope small claims court will make me whole.

I too have been stung by this beck's Fiasco.... TWICE! They owe me $1,000 in groceries for two separate purchases.

There was a report on this mess on KCRA 3 last night (2/23/10). The VP (Paxon) who declined to be interviewed gave a written statement that they (Becks) had identified another company to honor the committments, so here we go again. KCRA recommended calling Becks customer service to formally file a claim, if you haven't done so already.

We'll see what happens, but I'm not holding my breath. angry.gif

Hey folks, did you see the story on KCRA last night? Someone took Beck's to small claims court and won! I searched the court website and determined that just in 2010, there have been 12 small claims cases filed against Beck's , for breach of contract or some cases listed "other". If you are serious about getting your money back from Beck's, I guess we had better start filing those cases before Beck's runs out of money!

This is a letter from Becks today:
At this time, Beck’s Furniture now offers 3 options for our customers to chose from in regards to the voucher situation.

1. I can offer a new $600 grocery voucher
2. I can offer a $1000 in online savings. It’s like a online coupon book, it takes money off of purchases made on that companies web site. It includes entertainment, restaurants, clothes, and much more.
3. I can offer a 20% discount on your next purchase not to exceed the original voucher amount. This is a 1-time use.

The $600 grocery vouchers are issued to us from a company named Odenza. Consumers would be mailing there monthly receipts to Star Rebates Inc. This company works the same as the others, spend a $100 a month on qualify groceries and receive the $25 visa gift card. This company also has an option that if you have a preexisting visa they will send the $25 a month to your card when your receipts are approved. So no waiting for the gift cards to come in the mail.

The $1000 in on line savings bucks is through Destination Rewards. It gives you $1000 in savings bucks so for example they have $100 gift cards to Red Lobster, they offer $35 off using $35 of your savings bucks, so the out of pocket expense on the $100 gift card is $65. I know that many companies have been using this company’s savings bucks as a loyalty program for there customers, American Express, Wells Fargo and Citi Financial to name a few.


In addition, I can refund the $9.95 registration fee that was paid to My Free travel, with proof that it was paid. For example the registration validation form or the cancelled check.
The refund can be processed no matter what option is chosen from the above resolutions. Please let me know what options works best for you.

You would have to pick up the receiver on the phone in-order for you to receive or answer a complaint. It also helps to give a working telephone number where you can be reached.

Not keeping records of money (certificate) you gave clients, would make reporting taxes difficult.

I heard about another small claims victory today for a Beck's customer stung by Beck's scam.

And it appears that there are many more small claims cases pending.

I have been watching the small claims cases filed against Beck's. So far, 30 cases have been filed in 2010. I have heard that four cases have been to trial, and all four people suing Beck's for the grocery rebate program were successful!

I wonder if anyone reading these posts has filed, or is planning to file? It looks like we would have a good chance of winning and getting the $600 from Beck's.

I am planning to file soon, probably end of May.
More interesting question is :
Have the sue plaintiffs collected judgment from Beck's yet?
Can you please comment about the trial itself few words and give any tips?

I doubt any of the plaintiffs have collected from Beck's yet, because there is a 30 day waiting period to allow Beck's to appeal before the plaintiff can collect the judgement.

From what I have heard about these trials (and small claims court trials in general), is that the case goes very quickly, and the judge does not allow either party to elaborate with a lot of detail. If the plaintiff is organized, has exhibits prepared and ready for the judge, showing the sales receipt, grocery receipts, etc., it seems that judges are ruling in favor of the Beck's customers.

You can file electronically and it's easy! And if you win, you get all your costs such as filing and service fees included in the judgement.
