Folks I think the important point here is that one of the posters had identified an issue with several boats. I cannot say for sure but one of the "boats on the street or driveway" may have been FolsomWake's..... as soon as he became aware of the potential discontent regarding the boat he resolved the issue immediately. FolsomWake has been the most responsive to feedback I have seen thus far and I think we need to thank him for his quick action. Just like we should thank the other boat folks who have resolved the issues I/we have presented them with. I appreciate very much and would like to extend my sincere thanks to those who have rectified CC&R issues that others or I have risen.
We seem to have morphed this topic into a secondary subject and some additional ugly stuff.... It is very easy to get caught up in the frustration and anger along with feelings of disrepect and such... I myself have been guilty of this.... Here are a couple of my random thoughts:
We have been speaking about a specific CC&R violation and asking various residents to please resolve these issues. A violation does not necessarily mean that the person is doing it on purpose... and I would expect that in most cases is certainly not creating the violation to anger folks.... simply put there is no benefit for the violator. I think the best medicine and best path to resolution for violations is attempting to talk with the individuals one on one... if this fails then I will send a couple of letters.... then we get to the more official stuff. I pursue these actions as I only want to see the violation resolved..... nothing more... and while we may disagree on the circumstances of the violation or application of the CC&R's I do not like you any less... and I do not have any problem with you other than the violation.... whether it be a total stranger 5 streets over a best friend next door... I promise to apply my personal enforcement (afforded to me within the CC&R's) in an evenly applied manner. I will offer to help resolve the issue (pushing a boat into the garage, moving a garbage can into the side yard, or even re-positioning a satellite dish. I am of the opinion that referencing the fact that someone may need to move to a new neighborhood is not the nicest thing to say and really does little to encourage friendly cooperation between 2 parties.
We really do have a great neighborhood... and folks are generally very friendly. I think that resolution of CC&R issues without some of the negativity in the past is very possible.
In regard to the application of the CC&R's. The Willow Springs CC&R's do not mention a day to day governing body. The text does state that fellow residents have very much the right to enforce the CC&R's. Additionally the text states that your signatures (yes all of us signed) acknowledges you have read, understand and will abide the rules.... very similar to the contract you sign when financing a car. When financing a car you agree to pay $xyz per period ...... you sign your name to this acknowledging that you have read, understand, and agree to abide by the terms of the agreement. Going forward you still have the option of violating the agreement but there are nearly automatic repercussions of your action. Same applies to CC&R violations but unfortunately the repercussions are not so automatic.
The fact is that there is no intent published within the CC&R's intent is simply opinion and nearly everyone will have a differing opinion on this subject. The CC&R's are a binding agreement, we all signed on the dotted line. I would like to request that all residents follow the CC&R's and if by chance there is a violation work to find a resolution to the problem together.
It is refreshing to see the posts in regard to this subject... reading between the lines it tells me that folks in Willow Springs care...... no doubt about it... if you didn't care we would not be posting.
Here's to peaceful application of our CC&R's. Please let me know if there is anything I can do to help.

I think there is an assumption being made that all of my neighbors adhere to the CC&R's 100% and thus I am the bad guy in all of this. I can honestly say that within my immediate nighbors there are several occasional CC&R violations and they do not hurt anyone or drop the value of our nieghborhood, and they are temporary or not a big deal.
Well, after being called a bad person, dishonarable, been told to move, I think I am done with this forum. I made an assumption that this would be a healthy discussion regarding something affecting all of our nighborhood but it looks like it is just used to complain about stuff and call people names. Enjoy youselves, I will just spend more time on the lake instead.
I will leave you with this, be carefull what you ask for because you may get it. I can walk through the nieghborhood and point to several home businesses which are visible from the street periodically throughout the day and I beleive that is a CC&R violation, now we are messing with people's livelyhood. Just be carefull what you ask for.

Guess I don't know the definitions of "slanderous", "abusive", or "hateful". Yes, I was a bit strong in my attempt to get a point across.
And let's see, maybe I could just claim that I'm "interpreting" the rules of this forum, much like others want to "interpret" CC&Rs!

Terry, Thank you for your candor. Doug, it is my business. I am a resident of Willow Springs and a boat owner who follows the rules. I will not be scared away like pimpwagon. People with your attitude do not represent myself or my neighborhood and I will continue to post to this board.
