What? I'm confused. Are you saying that the Lake Forest Cafe owner has to pay the plaintiff just because they are being sued?

yes.  the lawyers fees to try to fight it would be huge.

So all a person has to do is walk around and sue businesses and if there is any merit, the business has to pay?  Who thought that one up?

exactly.  its a cottage industry.  from what I understand, his lawyer files these lawsuits on his behalf and others on a regular (like weekly) basis.  They started in the central valley and have been working their way north.

No, that's Kemp.  Kalini is from San Jose.

I think his attorney was from San Jose -- he is closer.

This is total BS just like at least 50% (likely many more) of the ADA issues out there!  Why aren't local chambers of commerce, our state and federal representatives, and folks at the (federal) small business administration doing something about this?  Where are the "advocates" for the small businesses?

 

I have no doubt that this worthless POS has: a) never visited Lake Forest and, b) never asked for accommodation.  He, his attorney, a significant percentage of disabled advocacy groups, and Mr. Kemp (for good measure) need to go to to &%!* and let us enjoy our town.

Yeah the law had good intentions to start with then it went off the deep end and nothing has been done to stop it, especially here in Lib land.

Actually California has its own more restrictive ADA laws and codes. Businesses have to keep track of both federal and state laws, the latter of which are constantly changing and almost a gotcha law for small businesses. The laws are so vague in some ways and such sticklers in other ways. A door jam a half inch too narrow? That will cost you thousands of dollars in fines and attorneys fees before any compliance modifications even begin. Diane Feinstein has been after Darrel Steinburg to do something about it. It's usually too little too late.

So this business owner had 31 years to address handicap access according to state law, and as long as she was never cited by the state she figured she could skate by and not adapt to the changing laws.

She did make changes. Big expensive ones. She thought she was in compliance. The laws changed on her over time.

Your missing the point.   Anyone who files a lawsuit such as this is only looking for money.   Look at the link already posted and you'll see this person files a lawsuit roughly  1 time per week.   That practically means this is his job.   He didn't come all the way from Ione to eat bacon and eggs at this restaurant.    Additionally, existing businesses should be grandfathered in unless they do a substantial remodel.    With a business this size it'd be practically impossible to retrofit the whole building and stay in business.    What has society as a whole gained from this law ?
