Sad to see another Folsom business close after being served with an ADA lawsuit.  There should be an exception for very old or historic buildings to do their best to accomodate those with disabilities but to a limit. 

 

To make it worse, it sounds like this was a drive-by ADA lawsuit where the plainiff has never tried to access the business.

I'm very sorry to see them go and am angry over these types of lawsuits. I wonder what the specific access issues were, but assume they were never brought to the attention of the owner. :(

She has been there for 31 years.  I know she spent a lot of money putting in that concrete ramp about 20 years ago.  Its so sad.  Now she and her employees are going to be suddenly unemployed.  I hope everyone goes in there and eats a big meal and leaves a big tip to help them.  It's going to be rough for them.

This sickens me, and this ADA lawsuit thing, often targeted at older businesses because they are easy pickings, seems to have become an epidemic around here. 

 

The reality is that the grounds of the lawsuit don't really even matter. Just being sued, even if you can ultimately win, is bad enough in terms of legal fees, invested time, and stress.  It's often better to walk away. 

 

This place is a landmark in Folsom and it will be missed.

I assume by them closing they don't have to pay these rip off artists a settlement, or do they ?

Yes, they do have to pay them and also pay their lawyer.  It is painful!  And now another group of new umemployed folks. 

Get in there before they close and leave a big tip!  :)

no, apparently not.  they get paid if they sue, no matter what happens to the business.

What? I'm confused. Are you saying that the Lake Forest Cafe owner has to pay the plaintiff just because they are being sued?

Losing sympathy for the handicapped one lawsuit at a time, way to go ADA!

 

From these BS lawsuits to over-weight people with handicapped parking tags it's hard to even feel any sorrow for all these "disabled" folks.
