has anyone noticed on the Folsom Watch page on Facebook that there were other "sightings" in town this week?  The police caught him at Briggs Ranch park.  He is Justin Kinter, 23, from Fresno.  He has been attending a rehab center in Rancho Cordova.  Book'em, Danno!

I spoke too soon, Arrested yesterday and released today, Under the current (AB 109-Prop 47) revolving door catch and release approach to public safety mentally ill sex offenders that repeatedly act out in public must now be considered low risk non-violent offenders.  

doesnt show what arrested for. just name dob and date released

I wonder if you have arrests mixed up?

That guy seems too young to be middle aged.

 

On the other hand- Police arrested this guy for child porn( probation offense)-- a known sex offender--

Ahhh, the *Dirty Harry* form of justice. Wouldn't that be nice !!

 

Pretty soon that's all we will have to protect ourselves with prop 47 freeing criminals to roam the streets.

Vigilantism may become the norm.

 

Cops hands are tied because of prop 47, so it will be up to us to protect our spouses and children.

 

Hopefully the kumbaya voters in this state will pass another feel good law that will make the murder of a criminal only a misdemeanor ticket offense (to help with cost of removing bodies).

well, there is a difference between exposing children to inappropriate behaviors and assault.

 

No, I don't think someone should get a felony on their record for punching some dude out that is masturbating in public-

 

I mean, if you knew you were gonna get a felony for punching someone for exposing your kid to public voyeurism then; ..... I imagine most people would put a few well placed kicks into play, as well

I know this is going a little off the topic, but Prop 47 converted a lot of felonies into misdemeanors.  My understanding is that if someone breaks into your house, but takes less than $950, its a misdemeanor!!  Same price value with shoplifting.  insane.

If you are charged with “residential burglary” (burglary of a residence), it will be charged as a felony for which you will face up to 6 years of state prison time.

 

If you enter onto another’s property and steal something, you can be charged with both criminal trespass as well with whatever theft crime you committed.

However, if you have other cases or charges that are holding you in custody, you will not be released even if you receive a reduction on one or more charges"[/size]

The courts may or may not let you out within a year.
They take in account prior history and severity of case. In some circumstances they push for a one year stay in prison or jail and then replace the rest of the prison time with concurrent probation time. 
 
In some circumstances they will tell you that as long as you are on probation they will not change your record under prop47= which means you have to complete the probation period.
 
So a guy who gets sentenced 6-10 years for residential burglary, trespass, and larceny could have his case dropped down to 3 misdemeanors however he has to serve a year of time in the county jail and 4-6 years on probation.  In some cases, they then further reduce the probation period if the person qualifies (first time offense, good behavior, good employment history, clean driving record, maintaining contact with probation officers, and not popping hot on piss test).
It usually takes 18 months to 36 months to have a record reduced from felony to misdemeanor and requires no active cases against you in the court system (according to an attorney friend)
 
 
 
so I have to ask you... how many people who get popped for residential burglary- stay clean for the seven to eight years it takes to clear felony charges off their record? 
 
Prop 47 isnt doing what well intentioned people think it is doing.
Sure, people with past criminal histories are getting them reduced, but people in the system are merely being released and told that if they control themselves (attorney, family and the individual know it wont happen) then with X amount of years they can get the charges reduced and move on with their lives.
 
The average person sees that as a hopeless fruit to chase. Heck most of them don't do well with time frame planning anyway or they wouldnt have given up on their dream (if they ever had any) and resorted to fast and illegal money gain operations.
 
So I agree, Prop 47 is another piece of Brown legislation

Someone breaks into your house there's an easy way to get around prop 47 catch and release.

where do you think the bad guys are go when the bullet trains rips through the state from San Francisco to LA?

 

If I was a city council person I would make a bill or law or regulation that directly addressed this.

 

Like: If you are arrested for warrants from outside the city you SHALL be fined no LESS than $300 plus costs for extradition and transportation to return you to the place your warrant originates.

Hello, my name is Justin Random Kinter, I am a 25 year old white male from Fresno, CA, and I would like to inform every single one of you that I had nothing to do with the incident that occurred in Elvie Perazzo park on May 13, 2015 nor do I have anything to do with any other indecent exposure incident that has happened at anytime anywhere, Every single thing Fox 40 News said was a straight up lie and I have been acquitted of all charges by a jury of my peers, not only this, but there is currently a petition for factual innocence that is currently filed on my behalf, I have several alibis for that day, I was actually out in the area working with my church that day and was located about six blocks west of the park when the incident occurred, just goes to show you that you can't believe everything you hear on the news especially fox40, oh yeah, and that you can't trust certain officers on the folsom pd because even though I revealed this information to them upon my arrest, they refused to investigate, instead choosing to believe that I was a liar merely because I had chosen to get my life back on track by checking myself into a rehab center. Anyway, have a great day everyone. Best believe I'll never be coming back to Folsom again after the warm reception I got, seriously, the worst year of my life dealing with this bs.

I looked up the story, and it said the man in question was placed under citizen's arrest until officers arrived.   Was that part true?  If so, was that you, and if so, how did that even come to pass?   And if it wasn't you, then how was it you who was the one on trial?
