This really is a loss for the community. Unless there is reform of the ADA laws chain restaurants in strip malls will be the only ones left.

While it is in the best interest for businesses to update their sites for the latest ADA compliance to possibly increase sales however there is a question if it should include older buildings or structures such as Lake Forest Cafe, the Capitol, Sutter's Fort, Empire State Building, Hearst Castle. Where do you draw a line?   And if you do update to the 2013 ADA guidelines, should you constantly rip up that costly upgrade to meet the new standards? 

 

The example of the SF eatery wanting to replace old nasty flooring should do it for health and safety without an additional consequence.  However if they want to add a full remodel, adding in as many of the new ADA rules should be done. 

 

Also anyone notice the increase in businesses posting "bathrooms for employees only" signs?  I assume to limit their risk of an ADA lawsuit.

Naw, thats 'cause they can then legally refuse "homeless" access to the bathrooms.

I've only seen one 'employees' only bathroom sign, and it was at a restaurant that had restrooms for customers, but one set aside for employees, presumably so that they could get in, get out and get back to work in comfort.

 

I recall seeing a shop years ago which had a sign on the window 'clean restrooms inside'. The owner found that by offering clean restrooms, people would come in and buy stuff.  

 

Just drove by and noticed the building is gone and only the picket fence remains of Lake Forest Cafe :(

 

My wife pointed that out. Sad.

  Maybe someone purchased the land and will  rebuild on it.  who knows but the whole set of circumstances that forced Lake Forest to close just sucks, plain and simple!

...I just found this thread.  What is sad is that so many people here, only want to hear one side of this story.  Here are the FACTS: I went to this restaurant because it was recommended by YELP APP. saying it was wheelchair accessible. Trying to enter the building was impossible , so we contacted the host asking if there was an alternative entrance for wheelchairs as the door opening was too narrow and the short slope too steep. He (host) had such a  lackadaisical attitude and his response was "sorry dude".

 

after filing this lawsuit the owner did not want to meet to discuss anything......noted here she did say something about 31years in business and she wanted to write a book....it was the perfect time to close anyway, it was slow going.

 

Might you suppose I was not the reason for closure, BUT the scapegoat??  Its just amazing how several individuals here want some sort of revenge for something they only knew part of.

 

Imagine if all doorways were only 64 in. tall.  Wheelchair users would have no problem entering thru them......how long before taller people DEMAND the doorway be taller....especially after 25 years of non-compliance?

 

I'm just sayin'

Wow. Please tell us why do you care what people think of you? I thought you threw that out the window a long time ago. It's quite strange to me that you decided after all this time to come here and try to get people to understand your side.

 

Look, if you try to enter a business that's housed in a modern building that was not built to code, or was later modified in a way that took it out of compliance with code, and the owner didn't care to address it, then I wouldn't blame you for filing suit.

 

But that wasn't the case here. We're talking about an old building housing a 31 year old business that was a fixture in the community, owned by a single individual who clearly did not have deep pockets. The interior was cramped. Even if she could afford to add a wheelchair lift outside, what about the bathrooms? She would have had to rebuild the entire north side of the building to achieve ADA compliance.

 

You had to have known the implications on the individual before you filed this.

 

Also, Yelp data usually comes from what random users decide to contribute. It's not verified.

 

The owner's preexisting desire to eventually close the business are absolutely beside the point.

that is not the story i heard from the owner.  she said they tried very hard to help him get in, but the chair was extra wide.  she said they had many customers who used to come in regular wheelchairs.  they were hardly the kind of people not to care at all.  she was devastated by the lawsuit and had to let go people who had worked for her for 30 years.  they all lost their jobs.  and the restaurant was going fine.  in fact, they had gotten Best Breakfast in Folsom in the People's Choice.  she is a breast cancer survivor and the stress from this was horrible.  it was very sad.  just glad its over for her.


Knowing the past helps deciphering the future.

This is a very difficult issue.  Of course, we all want places to be accessible to disabled people.  It is an issue that potentially affects all of us, as many of us will spend time in wheelchairs as we age. 

 

At the same time, it is simply a fact that there are places where it is financially or logistically impractical to have full ADA compliance.  As an example, I was at an athletic competition this past weekend.  I'm not going to be more specific, for fear Accessibility will run over and sue the venue(s).  Suffice to say, it was a type of competition that requires a lot of space, and dirt tracks (rather than pavement) all around the place.  It was a major hike from the dirt lot parking area.  The spectator area was a grassy berm, and the restrooms offered a choice of Porta-Potty or a trailer with steps leading up to it. 

 

Handicap accessible?  Definitely not.  And if the day comes that I find myself in a wheelchair and unable to attend these events, I will indeed be sad.  But I won't conclude I ought to sue the host businesses, who generally don't make a ton of money anyway.
