I can't imagine what this guy is going through. But I can imagine the wife's rage.

I wonder if the wife can also sue for emotional or mental trauma and lifelong suffering?

ok- so how does the claim go completely without merit? Did the man ask for an amputation?

I mean, it's there or it's not. Talk about a weird story.

Maybe He' was a she all along or already had some sort of accident or procedure preformed earlier. I suspect a reputable hospital wouldn't say this was without merit without knowing something. Making a statement like that after making such a mistake would only add to the pain & suffering award

Then again maybe the patient had an Obamacare plan!

"Banks, who is married and does not work due to a disability, did not recall the precise date of the incident but believed it occurred in June, his attorney said."

That's weird. You'd think he'd know when he went in for a medical procedure, that he'd have documents from the hospital, etc. Something is odd about this story. If he's already got an attorney, you'd think the attorney would have secured related documentation and that they'd know when this alleged incident happened.

Hm, according to this article the attorney asked for medical records two weeks ago and evidently doesn't yet have them. http://www.abc3340.c...n-files-lawsuit
