city council agenda for Tuesday next week:    using Resolution to change land usages

Re:   Item 8a city council agenda for Dec. 13, 2016, posted today.

In re:  APN 072-0270-120, located SE corner of Broadstone Parkway & Cavitt.
Resolution 9807  USA Properties to construct about 304 apartments on vacant land at this busy location.   The city is proposing to make a major impact on Land Usage, without the proper circulation of the General Plan Amendment (passed by city April 2016).

 

It is not clear if the city will pay the $780,000 subsidy.

It is not clear how apartments can be added & subtracted when this land was the subject of a secret General Plan Amendment.

Resolutions are meant for "temporary actions" of the city, NOT for permanent changes in Land Usage laws, gifting of money, inclusion of 304 Apartments with about 61 units of Very Low Income, and 12 units of Extremely Low Income.

 

The usual Neg Declaration of Environmental Impact, Attachment 23 is not present.  

Missing are the sewage and water utilities, the adequacy of city-owned sewage pipes and water supply for this development.  

 

Missing are traffic impacts for Highway 50, E. Bidwell, Engineer-certified Studies. 

 

Missing are the complete DETAILs required for a Planned Unit Development.  In fact staff opine that a PUD is intended to provide FLEXIBILITY of plans -- NOT CERTAINTY based upon Engineer's Reports, etc.

 

The Minutes of the Plan Commission are NOT INCLUDED in the packet for this temporary Resolution passage.   

An Ordinance is required.   

Minutiae of the twisted financing is included.     Engineers are not involved in this as required by laws.    Only unnamed Development staff were involved, and NOT the City Engineer.   

 

Army Corps Permits:   none are mentioned.   Instead of a water analysis consistent with Reclamation orders for Water Management, the city refers in passing to having a SWPPP -- which is not about water supply.

City acts as if such major changes can be done in a city closet, without regard to the impacts on the region, water, sewage, traffic, police.

Folsom Cordova Unified School District comments reveal there is NO CAPACITY available for the students resultant from this preposterous Resolution impacting Land Usages.  

 

The city regards this Resolution sufficient to cause the issuance  of Building Permits, construction, and dispensing of public monies for subsidy.

I think the council already approved the construction of the project.... that is where environmental impacts were considered.... the affordability make up does not in of itself cause an environmental impact...
