Unsafe Boat Parked in WS Driveway/Lawn

On a recent evening walk through the neighborhood I stumbled across a troubling scene while walking past a residents home on Pintail circle. I noticed that this particular resident has a boat parked half on the driveway, half in the lawn. This is simply an eye sore and CC&R violation. What I saw just recently is that this boat is now propped up about 2-3 feet with a pile of various wood materials under the trailer jack portion. This is a very sad but more importantly dangerous situation. I truly hope children who play throughout the area are not hurt if the front of this trailer & boat fall. I am going to try and catch the owner and talk with him concerning this. I am a Willow Springs resident and a boat owner myself.... My boat is stored safely and not in front of the house.... especially on the lawn smile.gif

That does sound dangerous. We all know how kids love to crawl under and around things (what if a child's ball rolls under there?) It would be a horrible tragedy if the boat fell and hurt a child -- not to mention a tremendous liability for that homeowner.

Thanks for having the concern to go talk to the homeowner.

you could leave a notice for the resident letting them know they are in violation of local ordinances.

after that, you should could then call local enforcement (PD) and they WILL ticket the offending parties. I know this has happened on Sprig Circle.

10.20.270 Utility trailers.

No person shall leave standing any utility trailer on a public roadway without having a vehicle attached to the utility trailer capable of immediately towing it at the request of a public safety officer. (Ord. 794 § 1 (part), 1994)

you will have to notify the neighbor regarding the CC&R's. They are somewhat tough to enforce though without a HOA.

Brett..... thanks for the link... unfortunately the trailer is half in the driveway... half on the lawn (and sinking).... of course the owner has now dressed it up with Christmas lights... that makes it better.... or NOT! madsmiley.png

This person is in clear violation of Willows Springs CC&R 1.11 entitled Garages and Vehicles. I have been working late most every night... so I have been unable to go knock on the door at a reasonable time. I may just deliver notice of violation as described in 6.17a of the CC&R's. It is unfortunate that we have to deal with this. I am confident, however, that this will be resolved utilizing the prescribed methods in the CC&R's.

I actually saw this boat today on Pintail and if you don't want to turn it in I will! It's clearly a safety hazzard. I live in this same development and it's always sad to know that people sign the contract egarding the CC&R's which prohibits this sort of thing but as soon as they move in........what contract? I'll be calling tomorrow

Called both code enforcement & Folsom PD and doesn't seem to interest either of them. If he were my neighbor I'd knock and talk to him about the CC&R's he signed and agreed to, the unsafe boat, the basketball hoop and the crap in side yard for all to see. Why is it that people move into a nice new neighborhood trash the place and disrespect their neighbors by not keeping up their homes or front yards. Move to a place where this isn't discouraged and park their cars on jack right at the front door. We had a neighbor who had their horse trailer parked in front of their home all the time, a few of the neighbors got together and all went to his home. It was a friendly plea to abid by the CC&R's and he actually moved the trailer to his business. Maybe you could discuss this with a few of your neighbors to see if they feel the same as you do and you could all discuss this with the disrespectful neighbor. Hope it works because his yards really looks awful, I'd be a little pissed off if he was a neighbor of mine. sad.gif

enforcing the CC&R's are very tough. without a Home Owners Association (HOA) it will be very hard to get the home owner to obide by the CC&R's. the ccrs exist to help the builder when they are "selling" the neighborhood to prospective owners. since they are the land owner, they can enforce the ccrs because they are still present at the time.

you might want to go the route of urban blight and see if there are any code violations present. another route and possibly the simplest is to ask the person to change what they are doing.

if that should fail, you could then gather signatures from other homeowners in the hood telling the person they are in violation of the ccrs. unfortunately, to enforce the ccrs without an HOA you will likely need to pursue court action.

try the "good neighboor" approach and see what you come up with.

Sometimes an anonymous note works well too.

The good neighbor thing may well work, but see if some other neighbors will help be there when you knock on his door.

Folsom Day Care.... good to hear we are in the same boat.... CC&R process as I read it is to notify the property owner via letter. I have sent one letter to this individual. I will be sending a seoncd today. I have knocked on the door 3 times during various times with no answer..... I will be aggressively pursuing this. I will notify this person 3 times via letter.... then off to my lawyer I go... I agree with Brett911.. that the good neighbor approach is the best..... however the person seems to never be home (even though there are vehicles there). I have captured photos of the garbage, boat, etc. I am not a direct neighbor of this guy.... however I do just live a street away.... this is nothing more than complete disrespect for everyone in the neighborhood.

Have you tried getting a phone number for the residence? Is it owner occupied or rental?

this might work, and it would be keeping in the christmas spirit. you have all the neighbors over for a party, give them a lot of drinks...instead of party favors you go to home depot and get a bunch of spray paint, green, brown, black is best.. then you go out and camofloge the boat. if you match the trees and colors it will blend right in and then you have the best of both worlds.....the guy with the boat won't have to bend to the cc&rs and the old boat will not be as visible and making everybody mad

Sea Ray Owner; any more news on the eye sore your way? I see nothing has changed as far as parking the boat next to the side walk even after complaints were made about safety(considering it is on blocks). Put a car on jacks in the front yard and it's set. whistle.gif
