depends where you live - you should have received some paperwork about it when you purchased your house

Interesting note about CC&R's- my friend lives in an older part of Sacramento, near Watt. His home was built in 1948 and when he bought it a few years back he had to sign off that he had read the CC&R's. He showed me a copy. The original CC&R's stated that no resident would allow a "negro" or "colored person" to purchase or rent their home, nor would they have "negro" house guests or visitors. The language was still there, but is clearly no longer enforced. Crazy stuff, eh? I guess they don't stay valid forever!

I believe that in the past couple of years there was a lawsuit that nulified that. Thank goodness, too. If I would have seen that in ours, I would have made a stink about it.

BTW, what's with not being able to see the CC&Rs until signing? It's part of the contract and I think one should be able to view them when putting in an offer.

CC&R's are only REQUIRED to be given to you if you purchase a) new construction or, b) a condo. If you buy a resale, single family residence then it is your responsibility to ensure you receive them. Many agents and title cos. give them automatically, but it is not required of them to do so.

Stuff like that will be in CC&Rs in areas that have no HOA maintaning and keeping the CC&Rs up today.
For instance, in 1991 the FCC came out with rules that overruled CC&Rs banning DBS satellite dishes and external antennas designed for local tv reception. However, some CC&Rs still contain "rules" that say you can't have a satellite dish or antenna because there is no HOA or management company keeping the documents up to date and removing illegalities.
