Willow Springs CC&R's

Does anyone have the CC&R's handy for Willow Springs....mine is packed somewhere! I'm trying to find out if there is anything about parking cars on the street. I know there is the vehicle code if cars don't move in 72 hours.....but I remember when we were in Natoma Station the CC&R's discussed no parking on the street and driveway!

I used to have the CCR's but I think I left it for the new owners. Good luck in your quest!

1.11 Garages and Vehicles: All driveways and garages shall be maintained in a neat and orderly condition. No automobiles, trucks, campers, trailers, boats or recreational vehicles of any type shall be kept or parked outside of a garage on any lot, for any period exceeding forty-eight (48) continuous hours. The time period of any intermittent parking shall be deemed to be continuous and shall cumulate towards the 48 hour limit unless separated by at least 48 hours. The intent of this limitation is for residents of a lot or parcel to park their vehicles in their garages, maintaining a clean and neat appearance of the Property while allowing guest and visitors to park temporarily therein. Notwithstanding the above limitation, a trailer, boat or recreational vehicle (but only one of them and only one per lot or parcel) may be parked on a lot or parcel and not within a garage provided that any such vehicle is parked in an enclosed area, is maintained in a neat and clean manner, and is not visible from the public streets within the Properties or from other lots or parcels. No vehicle of any type (including motorcycles) shall be parked in or upon any lot or parcel, excluding the garage, for the purpose of accomplishing repairs thereto or the reconstruction thereof, except for emergency repairs and then only to the extent necessary to enable movement of the vehicle. For any repairs conducted within a garage, the garage door(s) shall remain closed during any such repair work and any noise caused by such work shall not unreasonably disturb another Owner's quiet enjoyment of his Lor or Parcel.

Maybe you could send a copy to the folks on Pintail Circle who park that ugly boat, covered with a lovely bright blue tarp. I'm not to worried about people parking on their driveways, leaving for work everyday, it's the boats, trailers parked in front of homes for decor that bugs the heck out of me.

Parklady... great stuff... thanks for posting!! I have made several copies of the CC&R's for the benefit of our friend at 1009 Pintail (more on this below) I did notice that my copy does not include:

Interesting... yours must be newer than my copy.... I wonder where we could get the latest and greatest..... I would be very happy to post this on the web for easy accessibility.

Anonymous person.... I have delivered a complaint to the boat guy at 1009 Pintail three times... he should have received the third complaint yesterday... all 3 written complaints were accompanied by a full set of the CC&R's for their review. I have asked that this individual resolve the issue within 10 days of each letter.... there have even been delays in-between complaints... 2-3 months and nothing... so if by the end of day on the 26th... we do not see resolution I will be pursuing this with the help of my lawyer. I will not rest until this issue is resolved...

I agree with you 100%... it is unsightly... unsafe.... and plain unpleasant...

Park Lady.... all .... The copy of the CC&R's I have is the First Amended and Re-Stated Declaration.... dated May 4 1998... per the Sac County Clerk/Recorders Office online search system (http://www.erosi.sac....net/Inputs.asp).

Park Lady is your copy entitled:

Declarations of Covenants, Conditions, Restrictions, Reservations, and Easements of Willows Spring which recorded March 12, 1998 in book 980312 page 979 of Official Records

?

If so the copy I have cancels yours and "supersedes in it's entirety".....

If this is the case... the text I mentioned above must have been removed with the Amended copy...

I would be more than happy to provide you with this copy if this is truly the latest and greatest....

It seems that 1009 Pintail Circle doesn't care how they have brought down the neighborhood. The blue tarp has blown away in the last storm and I think they might have removed the festive Christmas lights. I wonder how the neighbors on both sides of the boat feels about their neighbors lack of consideration? weirdsmiley.gif

I would agree completely... there is a complete disregard for the neighbors and neighborhood in this situation. I do not live on Pintail but this needs to be dealt with. The last letter which was sent gives them until the 26th of Feb to resolve... my guess is that we will have to take the next step.... I am very prepared to do this.

That's the problem, there is no one to enforce the CC&R's. CC&R's are written up to give home owners the warm fuzzies when they buy a home wedgie.gif If there isn't a homeowners association to enforce the CC&R's their isn't a whole lot you can do, besides approaching the violator. It appeared to be a safety issue, but code enforcement must not have thought so because nothing has been done. I'm still wondering how the direct neighbors feel about this person violating CC&R's and bring down the neighborhood with the boat and garbage out in front of the home confused.gif Some people really arn't meant to be homeowners or pick the wrong neighborhood to live in. Maybe if they lived out in the country with a few acres they could pig up the place and nobody would notice. They could even park their car on jack right at their front door specool.gif

Cloud9.... I have delivered the third notice to 1009 Pintail..... they should have received by the 16th. I ask them to resolve the issue within 10 days. If after Feb 26 they do not move on the issue I will pursue this matter to the fullest extent under the CC&R 6.01 Enforcement which reads:

Any owner, and/or the holder of a mortgage of an Owner, (the "Mortgagee") shall have the right to enforce, by proceedings at law or in equity, all restrictions, conditions, covenants, and reservations, now or hereafter imposed by the provisions of this Declaration or any amendment therto, including the right to prevent the violation of any such restrictions, conditions, covenants, or reservations and the right to recover damages or other dues for such violation. Any Owner shall also have the right to enforce, by proceedings at law or in equity the provisions of this Declaration and any amendments thereto


Basically you can pursue resolution to the issue with legal proceedings... I intend to do this if not resolved by Feb 26.
I have attempted to speak with this neighbor several times without success in contact.
