Drainage Problem And Elliot Homes Lack Of Care

Hi,

We moved into new home in Riata community in August 2004 and noticed drainage problem in our front yard. We raised several service notices and also logged it in the annual inspection. Despite escalating it up to General Superintendent Mel Duncan, still there has been no action. What are my options –
1. Complaint to the State contractors Licensing Board
2. File complaint in Sacramento Small Claims court (does our purchase agreement allows it?)
3. Complaint to Better Business Bureau
4. Complaint to KCRA3

Any thoughts/advice would be appreciated. Also, does anyone know(address, etc) how I escalate it up the chain to corporate office beyond Elliot’s Folsom office at Iron Point Rd? I would definitely like to escalate it up to Mr. Elliot.

Come on....There are NO drainage problems in ANY of the new ER Elliott properties. None.

If you stop over-watering your lawn, then all your problems will go away. And if any soggy lawn/sidewalk issues persist, then it is the City of Folsom's fault for not letting Elliott bring the drainage out to the gutter.

This is what we were told. Remember, it is NOT Elliott's fault. cuss3.gif

I don't know about this issue personally so I can' speak on it... but I live in ER and when out for walks around the neighborhood I end up seeing a lot of people wasting gallons upon gallons of water every day! It is amazing that people think that watering the gutter is accomplishing something in their yard!

Haha! Watering the gutter seems to be the norm in our neighborhood. The medians and community areas too, not just the houses. It really bothers me to see so much water being wasted. We have some drainage issues as well, but our back neighbors are watering some of our hillside and will save us money once Folsom implements water metering. smile.gif Our front lawn gets boggy in spots and the drain is installed in the wrong area- we can move the drain when we overhaul the front yard some day. We had to add a TON of drainage lines in our backyard and still have to rip up part of our lawn and another area of our garden to add more. We have a back hillside and the swale does not work the way it was designed. All the rain last year was a good test of our drainage system and now we know what improvements will be needed in the future.

I can't wait for the meters. Then maybe some of these people will realize that watering the street isn't really productive!

I find it funny when people continue to water during the winter as well!

Yeah, I agree.

Just like I can't wait for electricity to be metered, so our silly neighbors will think twice about running their AC when it's in the 50s in the morning (instead of opening their windows). Oh, wait. Never mind. rolleyes.gif

Good point. Some people will never learn.

Moss does grow nicely on sidewalks when constantly wet.

Similarly... has anyone noticed that the retaining wall for some of the yet to be developed lots along the east side of Empire Ranch Road close to Natoma have be removed. There appears to be some work going on in the area. I wonder if this has to do with some poor drainage?

My neighbors do this; they are just too worried that someone will come into their kids' bedrooms when the windows are open.

Hi, I have a house in Elk Grove that was built by Elliot Homes. I found this site on google because the development of Shoreline Estates by Elliot Homes has a drainage problem that many homeowners are being fined for by the Laguna West Homewowners Association. The drains from the landscaping of my house ends at the sidwalk and the water runs over the sidewalk to the gutter. Algea then grows on the sidewalk. This is a huge problem since somebody walking on the sidewalk can slip and fall, causing a million dollar law suite. This problem is not just in Riata!!! The problem started in 2002 when all the drains were covered over when they installed the sod. Then a chunk of concrete 3-4 feet in diameter and 2 feet thick was found under the front lawn. The landscaper contractor's name is MARK HEMMINGTON. He is the problem!! The only way that I can stop the water fom continually running over the sidewalk and causing algea to grow is to manually turn off the water supply to the valves by the main supply valve on the house. Yes, if the sprinker valves are turned off, the water still flows out of the drains over the sidewalks. The drain pipe should have been installed under the sidewalk like with most other develpers. This is a design flaw by Elliot Homes and there must be a leak in the water supply pipe that feeds the drain. I have made complaints against Elliot Homes and Mark Hemmington about this for years since 2002. Mark spits at me in return. I have gotten no satisfaction and now l am on the hook from my HOA to solve the problem. This might mean alot of money for me if I fix it myself and if I don't fix it. Once again, this is a design flaw by Elliot Homes and shoddy workmanship by Mark Hemmington. It is not just in Riata, but also in Laguna West! It is well known. Haven't you folks ever heard of class action?
It's pretty simple...place a flyer on the mailboxes in your neighborhood scheduling a meeting. Once you get enough people who are ready to take action you simply send a letter to the builder with your intent to take him to court if he doesn't take action to remedy the problem. Usually the super will contact you and get something going...the last thing they want is a pissed off community logging lawsuits against them. I'm sure you have an attorney in your area who can handle the paperwork...if not go to Nolo.com to get the appropriate info and get it started. The builder is responsible for up to 10 yrs for defects on construction. Landscape & drainage issues might not fit within that definition but building according to code certainly is and this sounds as though it is violating code regulation. When I purchased my home in Talus Ridge I had Elliotts boys out at least once a month fixing something...that's the hardest part of new home ownership...nagging the builder to fix what wasn't done correctly in the first place.
I'd be curious to see how it shakes out.
