Hello,
I will be moving to Empire Ranch in two months, and I have a question about HOA rules for the backyard. I know there are HOA rules for the front yard, but are there rules for the backyard inside my fence?
I am told that certain things that need to be built or working on major projects will need to have an approval from HOA. Is it true?

Yes, some things need approval first. If you are going to do big structures and things that can be seen from the front you will need approval.
Also, there is a list of approved plants and trees (it's pretty extensive).
If you bought a house they should have given you the book and that will list all of the info.
Concrete patio, grass, etc stuff is up to you and you don't need to get those approved.

Actually, if you back to the golf course in ER you do need approval for backyard changes. The HOA book is pretty clear on what needs to be reviewed by them so if you did not get the book when you bought the house, make sure to call the HOA and ask for a copy.

I think it is more than just the golf course, I believe the additional backyard restrictions apply to any home that has to have the see through wrought iron fences as their property is adjacent to an "open" area. If you have a completely solid wood fence around your backyard, there are fewer restictions on what you can do.

Technically you need to get permission from both sides of neighbors and sometimes submit plans for landscaping and other changes. There was also a rule about having the backyard landscaped within the first year and as a two story house owner can tell you they haven't enforced that. I wouldn't worry...it bugs me to high end when I ride or walk around the neighborhood and see terrible kept yards and weeds all over. So much for HOA doing anything!

And if you do have a valid concern, do not expect the HOA to respond.
Our neighbor planted two trees too close to the fence. (The CC&Rs clearly spell out the tree planting requirements.) Moreover, the neighbor planted another two trees directly on the property line in the front yard without talking to us. These trees are not on the approved list, and will eventually grow so large as to potentially affect our property......Bottom line, the HOA did nothing to assist us. Neither do they bother with neighbors that cultivate weeds and do not own an edger.
The HOA does not enforce CC&Rs. It appears that they simply want your $$ to pay the landscapers that service E. Natoma & Empire Ranch Rd.
You're probably safe in doing whatever you want in your backyard.

There is a house down the street that needs to edge! I used a spool of line one time trying to help them out. The yard looks awful!

Actually, they do. They are not consistent, but when they do, they are in full force. We keep our property nice all the time and the one time we were gone on vacation for 2 weeks, we got a citation for the dandelions on our lawn and not maintaining our home according to CCRs. But I won't go into all the other violations in our neighborhood that go un-cited every day......

You are absolutely right about the inconsistency.
One of our neighbors received a warning about a less than perfect lawn. We all laughed when we considered the many more flagrant abuses of the CC&Rs that seem to go on year after year at the same address......Who knows. Perhaps these residents regularly pay fines in order to not maintain their yards. Yet, I doubt it.
